3. INFORMATION WE COLLECT

3.1 Information Provided by Customers. When Customers subscribe to our Services, we collect business contact information (name, email, phone number, company name, title), billing and payment information, domain information for email sending purposes, ideal customer profile specifications and campaign instructions, and any other data or materials Customers provide to configure the Services.

3.2 Prospect Data. To provide our Services, prospect contact information may be obtained from third-party data providers and publicly available sources. This may include names, email addresses, job titles, company names, company information, and other professional data. Silenium acts as a data processor on behalf of our Customers with respect to prospect outreach activities. Customers, as data controllers, are responsible for ensuring that their use of prospect data complies with all applicable laws. Customers are responsible for establishing and maintaining a lawful basis for processing personal data in connection with their use of the Services. Silenium does not independently determine the recipients, timing, or content of outreach communications.

3.3 Information Generated Through the Services. In the course of providing our Services, we generate and process email communication content (produced by automated systems), email interaction data such as delivery status, opens, and replies, prospect response data, campaign performance and analytics data, and engagement classifications. Certain processing activities may involve automated decision-making or classification of communications and responses.

3.4 Website Information. When you visit silenium.ai, we may collect information automatically, including IP address, browser type and version, device type, pages visited and time spent, referring URL, and general geographic location. We may use cookies, web beacons, or similar technologies to collect this information. You can manage cookie preferences through your browser settings.

4. HOW WE USE INFORMATION

We use the information we collect for the following purposes:

To Provide the Services: Including sourcing and researching prospects, generating and sending outreach communications, processing and classifying responses, delivering engagement data and analytics to Customers, and managing campaign operations.

To Operate Our Business: Including processing payments and managing billing, communicating with Customers about their accounts, providing onboarding and implementation support, and responding to inquiries and support requests.

To Improve Our Services: Including training and improving automated systems using aggregated, anonymized, and de-identified data, analyzing usage patterns and performance metrics, developing new features and capabilities, and generating industry benchmarks and insights. We do not use Customer confidential information or personally identifiable Customer data to train or improve generalized models.

For Legal and Compliance Purposes: Including complying with applicable laws and regulations, enforcing our Terms of Service and other agreements, protecting our rights, property, and safety, and responding to legal requests and preventing fraud.

5. HOW WE SHARE INFORMATION

We do not sell personal information. We may share information in the following circumstances:

Service Providers: We use third-party service providers to help deliver our Services, including cloud hosting and infrastructure providers, email delivery services, data enrichment providers, and analytics tools. These providers access personal information only as necessary to perform their functions and are contractually obligated to protect the information they process.

Customers: We share prospect engagement data, response information, and campaign analytics with the Customer on whose behalf the outreach was conducted.

Legal Requirements: We may disclose information if required by law, regulation, legal process, or governmental request, or if we believe disclosure is necessary to protect the rights, property, or safety of Silenium, our Customers, or others.

Business Transfers: In connection with a merger, acquisition, reorganization, or sale of assets, personal information may be transferred as part of the transaction. We will notify affected parties of any change in ownership or control of their personal information.

6. DATA STORAGE AND SECURITY

We store data on secure cloud infrastructure. We implement industry-standard security measures to protect personal information, including encryption of data in transit and at rest, access controls and authentication mechanisms, regular security monitoring, and incident response procedures.

While we take reasonable steps to protect personal information, no method of transmission over the internet or electronic storage is completely secure. We cannot guarantee absolute security.

Personal information may be processed in the United States or other jurisdictions where data protection laws may differ from those in your jurisdiction.

7. DATA RETENTION

We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, including to provide our Services, comply with legal obligations, resolve disputes, and enforce our agreements.

For Customers, data is retained during the term of the Services and for thirty (30) days following termination to allow for data export. After this period, Customer data may be deleted. We may retain anonymized, aggregated data indefinitely for analytical and improvement purposes.

For prospect data processed on behalf of Customers, retention is governed by the Customer's instructions and applicable law.
